The first and foremost task of the executor or administrator in probate proceedings is to make inventory of the assets and properties of the deceased. Then he must collect and realize the dues of the estate. Thereafter he must pay the debts, taxes and duties of the deceased out of the said corpus.
Last but not the least; he distributes the assets and properties among the beneficiaries under the Will as per directions therein or in the absence of a Will according to the intestacy laws of the concerned state or jurisdiction.
In course of the probate case there may be claims against the estate of the deceased. In case the claim is rejected or not satisfied, the aggrieved claimant may institute money suit for the realization of his dues.
When there are claims on the estate of the deceased pending adjudication, each and every transfer or alienation of the property of the deceased may call for the approval of the probate court.
