The Indian Trust Act lays down certain provisions which authorize the beneficiary to transfer his interests in the trust property. A beneficiary or where there are several beneficiaries, if all of them agree, can direct the trustee to transfer the trust property to him or to all of them in case of several beneficiaries or to such other person as the beneficiary or the beneficiaries may want. The interest of the beneficiary in the trust property can also be transferred and every such person, to whom interest of a beneficiary has been transferred, acquires all the rights and liabilities of the beneficiary at the date of the transfer. However, only a beneficiary, who has attained the age of majority, is of sound mind and who is not disqualified by any law for the time being in force in India, is entitled to effect a transfer of his interest in the trust property. Where the beneficiary is a married woman and the trust property has been gifted to her or left by a will in her favor via the trust to ensure that she would not deprive herself of her beneficial interest the trust property, the interest in such trust property cannot be transferred at the instance of the beneficiary.
