Product Liability is the law for compensation of the victim for physical injuries and property damage suffered due to defective product, faulty product design, manufacturing defect or due to the failure of the manufacturer or seller to caution the customer of the product dangers.
The victim can make the product liability claim for loss sustained against the manufacturer or the seller.
Even in the absence of a contract the aggrieved consumer can proceed to recover damages for the loss suffered under the law of torts. Tort is a civil wrong that can be redressed by a legal action for damages.
The manufacturer or the seller may also be liable on a false representation made regarding the product, which the customer believed in or relied on. However, they would not be responsible for any subsequent modification or interference with the product, which renders the same defective.
