The Indian Wireless Telegraphy Act, 1933 prohibits the possession of wireless telegraphy apparatus without any licence by any person except under the provision whereby the government provides exemption to any person or any class of persons from the provisions of this Act either generally or subject to prescribed conditions, or in respect of specified wireless telegraphy apparatus.
The Act provides that the telegraph authority constituted under the Indian Telegraph Act, 1885, is the competent authority to issue licenses to possess wireless telegraphy apparatus in the prescribed manner. The provision of penalty constitutes a fine of Rupees one hundred in the case of the first offence and in the case of a subsequent offence, a fine which may extend to two hundred and fifty rupees.
