The sale contract should contain all details of all existing leases or tenancy agreements. If the property has existing tenants but the property is about to be sold, then the seller has to ensure that he will hand over free full and final possession of the said property to the purchaser free from all encumbrances. The seller must take steps to terminate all tenancies before handing over the said property to the purchaser. Therefore, early regard should be given to whether any of the tenants have security of tenure and thus a legal right to remain in occupation of the property in question.
