Special conditions are transaction specific. The relevant special condition is introduced to modify a general condition if the parties agree to change or delete a general condition. The last page of the Law Society standard form of contract contains certain special conditions that are common to almost all transactions. Depending on whether the property is to be sold with vacant possession or subject to tenancies one of the alternatives in the special condition must be modified. The seller’s attorney is the best person to judge whether any additional special condition is necessary or not apart from the conditions that are printed on the form. When a part of a property is to be sold, the part parcel and boundaries are to be clearly expressed in the special conditions.
