Seller’s Duty of Disclosure : Disclosure of Occupiers
The question here is whether the seller is liable to disclose the purchaser about any other person’s occupation of the property. It is the duty of the purchaser to find for himself whether the property that he is about to buy if free from all encumbrances. The question that arises here is whether the purchaser’s duty of inspection really has to do with a different question, mainly whether the purchaser is bound by the third party occupier’s interest. The best thing for the seller is not to go into any controversy but to disclose everything to the purchaser.
