The particulars contain the jurisdiction and boundaries of the property that is being sold and its tenure i.e. whether it is freehold or leasehold. The particulars also speak of the encumbrances subject to which the property is being sold. If the land is easily identifiable or can be easily located, then the simple postal address is enough but if not, then a more detailed description is required which may include a scale plan along with measurements. This usually happens when a portion of a property is being sold. The description of the property in the property register of the title and the title number along with the class of title can be used in the case of a registered land. It is mandatory on the part of the advocate to search for these entries in the land certificate or office copy entries. In case of an unregistered land, the description of the land in the previous conveyance can be used although its truth should always be verified. Any sort of discrepancy might entitle the purchaser to withdraw from the contract or seek a decline in the purchase price.
