Section 11 of the land Registration Act 1986 amended and simplified the original conversion of title provisions of s.77 of the Land Registration Act, 1925.
Qualified to absolute or qualified to good leasehold
When the Registrar is satisfied with the title details, upgradation becomes possible. In such a case, the qualification need no longer be considered. Satisfactory evidence of title deeds is essential to enable the upgradation to take place. If the Registrar has not seen the details of a superior title, then a good leasehold will be issued.
Possessory to absolute or possessory to good leasehold
This is possible in two circumstances:
If the proprietor can reveal 12 years of registered title ownership alongwith the exclusive possession and occupation
By disclosing to the Registrar satisfactory evidence of ownership of title of the concerned property. If the Registrar has not seen the details of the superior title, a good leasehold title will be issued.
Good leasehold to absolute leasehold
This is the most important of all conversions and also the most popular. As long as the applicant can produce the freehold reversionary title together with any intermediate superior leasehold title to the Registrar, a good leasehold title can be upgraded.
