Deduction of the title is governed by s.110 of the Land Registration Act if the sale property has a registered title. Under s.110, the buyer’s advocate is entitled to receive, inter alia, from the seller’s advocate, a copy of the entries on the register of title, a copy of the filed plan and copies of any other documents noted on the register. In such cases, mere photocopies will suffice and they need not be in original. The office copies must be less than 12 months old and should preferably be up to date. The office copies have to be applied for in the Land Registry Form 109 to the District Land Registry for the area in which the property is situated. As soon as the title number of the property is received, the application can be made. Form 110 delivers the copies of the documents referred to on the title deed and held by the Land Registry. In case one does not know the title number or there is a delay in receiving the deeds, the only way is to apply for an index map search at the Land Registry and attach to it the application made for office copy entries. Unless a property can be easily demarcated from the postal address, a site plan should be attached to the deed. After this, both the applications are processed together assuming that the concerned land is registered. Since 29th May, 2001, the office copies show a time of issue as well as the date. The need for a time of issue arises when land Registry searches are to be made and also when applications are to be made on ‘real time’ basis. Therefore, now it is possible for various versions of the register to exist on the same day.
