Immigration.But the residence of immigrants is subject to the conditions set by the Immigration Law.


Transferable Property

Regarding the transferability of any property, the Transfer of Property Act, 1882 lays down that any kind of property may be transferred other than properties of certain nature provided as exception. The following nature of the property cannot be transferred:
  1. the probability or chance of a person who is an apparent heir succeeding to an estate; the probability or chance of a person who is supposed to obtain a legacy on the death of his relative; and any other probability of similar nature.
  2. Right to resume possession of property.
  3. Right of easement on property other than the right on such part of the property to which the benefit of easement is attached.
  4. The interest to any property cannot be transferred by a person, if such interest is restricted in its enjoyment by him.
  5. The right to future maintenance.
  6. The right to file any suit.
  7. The right to public office and the salary of a public officer.
  8. Stipends allowed to military and civil pensioners of and political pensions cannot be transferred.
  9. Any transfer that is opposed to the nature of the interest affected or any transfer for an unlawful object or consideration or to a person legally disqualified to be transferee.
  10. An untransferable right of occupancy of a tenant, the farmer of an estate cannot assign his interest in the holding in respect of which any default has been made in paying revenue. The lessee of an estate under the management of a Court of Wards.
