Transfer of Immovable Property during Pendency of Suit
The general principle on transfer of property lays down that during the pendency of any suit, if the subject matter of the suit, that is the property, is alienated, the suit cannot be brought to its successful end. Therefore, the Transfer of Property Act, 1882 provides that where a suit initiated in good faith is pending before a competent court, in which any right to any immovable property is directly or specifically in question, such property cannot be transferred or dealt with by any party to the suit affecting the rights of any other party to the suit. If such transfer does not affect the rights of any party to the suit, it may be allowed with proper permission of the court.
