Different persons may have interest or claim over the mortgaged property. According to the provisions of Transfer of Property Act, 1882, besides the mortgagor, three different kinds of persons are entitled to redeem or institute a suit for redemption of the mortgaged property. Any person having an interest in or charge upon the mortgaged property or upon the right to redeem the same. This category of persons would include a subsequent mortgagee, purchaser of the equity of redemption, co-mortgagors and sub-mortgagee. A Surety for the payment of the mortgage-debt or any part thereof is also entitled to redeem because if the mortgagor does not pay off the debt, then his surety would be liable. A creditor of the deceased mortgagor who has obtained a decree for sale in a suit for administration of the estate is entitled to redeem, so that he may get the benefit of his decree. Any of the above category of persons other than the mortgagor, shall have the same rights in respect of redemption, foreclosure or sale of such mortgage property as the mortgagee whose mortgage they redeem may have against the mortgagor or any other mortgagee.
