In respect of operation of transfer, The Transfer of Property Act, 1882 provides that in the absence of any evidence of any contrary intention, it shall be held that the transferor intended to transfer all his interest in the property and incidental rights known as legal incidents. Legal incidents would include distinct rights in cases of different kinds of property. In case of transfer of land, the legal incident includes the easements attached with the land, the rents and profits from the land after the transfer is made, and all things attached to the earth. In case of transfer of machinery attached to the earth, the legal incident includes the moveable parts of the machinery. Where the property is a house, the legal incident would include the right of easements annexed to the house, the rent of the house accruing after the transfer, and the locks, keys, bars, doors, windows, and all other things provided for permanent use of the house. Where the property to be transferred is a debt or other actionable claim, the legal incident would include the securities for such debts or other actionable claim except where the securities are also for other debts or claims not transferred to the transferee but would not include arrears of interest accrued before the transfer and where the property is money or other property yielding income, the legal incident includes the interest or income from such money or property accruing after the transfer has been made.
