According to the provisions of the Transfer of Property Act, 1882, if any property is transferred upon a condition or limitation which absolutely restrains the transferee or any person claiming any right under him, from parting with or disposing of his interest in the property, such condition or limitation is void. There is an exception to this provision. A condition in a lease for the benefit of the lessor or those claiming any right under him is not void if the property is transferred to or for the benefit of a woman (not being a Hindu, Mohammedan or Buddhist), so that she shall not have power during her marriage to transfer or charge the same or her beneficial interest in such property. This provision makes it clear that the right of interest is incidental to the ownership of the property.
