Judgments of the Week

Judgments of the Week touch on those recent decisions which meet the parameters or yardsticks sought for in this regard.

Decisions which throw light on the grey areas of the Staute Law may find place here. Many unforeseen contingencies arise for which the Staute Law cannot provide for, since every such eventuality cannot be in the contemplation of the law maker. Here the Judges step in to supplement the Staute Law through interpretation of the same. The vacuum is thus filled in by judge made law or judicial decision which is amongst the matters of the Judgments of the Week.

Further there are path breaking decisions rendered by the Courts which are deviations from the so long held positions. Court decisions which are expressions of departure from the status quo postures form one of the elements of this Judgments of the Week section. After all, law has to move ahead in tune with changing times.

Moreover there are many legal issues on which judicial opinion is divided amongst coordinate Courts leading to confusion on the state of the law amongst the users. Decisions in which such raging controversies are put an end to by the Superior Courts by clarifying the position of the law also find place in this section Judgments of the Week.

Last but not the least, often minority dissenting views of large majority benches are ignored since these are not binding and enforceable. However often these decisions turn out to be very illuminating thought provoking and bold and more interesting than the majority decisions which conform to the norm. These undeservingly neglected decisions find due appreciation and recognition in the Judgments of the Week section.
