The concept of trademark is for protection of the sign, symbol or logo that makes the product of a business house unique to customers. Under trademark, a sound, logo, color, slogan, name and domain can be registered. A trademark must be:
  • Identifiable with the services and goods provided by the concerned business house
  • Not against law and morality.
Only if the above-referred conditions are fulfilled, the registration of a trademark may be applied for. Registration of trademark is optional. However, an unregistered trademark also enjoys protection under the common law and the violator of the same would be liable for passing off. A registered trademark must be renewed after every 10 years in order to keep it running.
