Insurance against burglary and theft is one kind of general insurance. Different insurance policies define burglary and theft in different manners but the meaning of these terms must conform to same meaning given in the Criminal Law. In some policies, burglary has been defined as ‘theft which involves entry or exit from a building by forcible and violent means’. The element of ‘forcible and violent means’ must be proved by the insured in the event of any theft or burglary to claim the assured amount. If Insurance policy against burglary and theft imposes any condition upon the person assured, the claim shall fail if the insurer successfully proves breach of the condition on the part of the assured.
