Consequence of Adoption

Consequence of adoption is manifest since it affects the rights and obligations of both the adoptive and natural parents as well as of the adoption child in the USA.

Adoption terminates the rights and obligations of the natural parents over and in respect of the child. Even the demise of an adoptive parent does not restore the rights of the biological parent over the child.

Adoption creates the same rights and obligations by and between the child and adoptive parents, as it existed with his natural parents before adoption. An adopted child enjoys the same rights as the natural child. However, when an adult is adopted, the adoptive parents are not liable for usual child support.

Law of the concerned state or jurisdiction determines whether the name of the child is liable to change by adoption. In case, where a minor is adopted, his legal abode stands changed from that of the natural to adoptive parents.

Law of the concerned state or jurisdiction in the US determines the inheritance rights of both the adopted child and the adoptive parent. State laws usually provide that adopted children are entitled to inherit property left behind by the adoptive parents just like natural off springs. Conversely, in case the adoptee predeceases, the adoptive parents inherit the assets of the child.

In the wake of adoption, the original birth certificate is sealed and no longer available to the public except by a Court order, in extra ordinary circumstances. In the new birth certificate, under the child’s new name, the adoptive persons are referred to as parents of the child, without any reference to the natural parents and without any indication whatsoever of the date and place of adoption. However, it lists the date and place of birth of the concerned child and the age of the adoptive parents, when the child was born. In states that permit adoptions by lesbian and gay couples, both the same sex partners are shown as parents. The child is unlikely to know that he was adopted, unless the adoptive parents disclose the same, since the original birth certificate is sealed away and no longer accessible.
