Divorce for unreasonable behaviour

The petitioner has to prove that the respondent is guilty of unreasonable behaviour and the relation has gone to the extent wherefrom reconciliation has become impossible. In the petition, the petitioner has to give in writing certain examples of unreasonable behaviour of the respondent. The petitioner also has to clarify as to why the unreasonable behaviour of the respondent has made it impossible for the petitioner to live with the respondent. If the respondent is sexually associated with a third party but the petitioner is unable to prove the same, then the same tantamounts to unreasonable behaviour.

Desertion : The petitioner has to prove that the respondent has deserted the petitioner for a period of at least 2 years. The petitioner has to provide the date when the cohabitation ceased and he also has to state that since then , the cohabitation never resumed again. If the exact date of desertion cannot be given, then an approximate date can be given after which 2 years have passed

Separation with consent for 2 years : The petitioner has to prove that the petitioner and the respondent have been living separately for a minimum period of 2 years. Furthermore, the petitioner as well as the respondent has to agree upon the divorce. The divorce in this case must be under mutual consent. The actual reasons for the separation as well as the date of separation have to be incorporated in the petition.

Separation without consent for 5 years: In this case, the petitioner has to prove that the petitioner and the respondent are living separately for a minimum period of 5 years whether or not each of the parties agree to a divorce or not. In this type of a divorce it is not mandatory to get the consent of both the parties. Furthermore, the exact date of separation is also not required provided the separation period has exceeded a minimum of 2 years.
