Immigration.But the residence of immigrants is subject to the conditions set by the Immigration Law.


Compulsory Registration of Adoption

In UK, since 1975, it has become mandatory that every adoption has to be registered in the Adopted Children Register. Once the adopted person attains the age of 18 years, he has to apply to the Register General for his original birth certificate. Since 1984, it has become mandatory on the part of the Registrar General to maintain "Adoption Contact Register" containing the names of the adopted persons and their relatives. When an adopted person applies to the Registrar General, he will be provided with the names of his parents. Thereafter it is the responsibility of the adopted person to contact his parents or guardian.

Remotion of a child : While an application for adoption is pending in a Court of Law, the parent / guardian who has agreed to give the child for adoption, cannot remove him from the applicant’s home. If the child is from an adoption agency, the also he cannot be removed without the permission of the person’s who will adopt him or a Court’s order. An application for an order of the child’s return or to prevent an intended removal can also be filed. Search and find orders can also be made in the High Courts and county courts.

Sole Applicant: Only on certain conditions can a single parent apply for an adoption.
  • A married sole applicant can apply for adoption if the other spouse is missing or have separated for good or the other spouse in mentally incapable of making an application for adoption
  • A Court can allow a father or a mother to be a sole applicant if it is satisfied that the other natural parent is dead or is missing or the child does not have a parent as he is governed by the Human Fertilization of Embryology Act
  • When a stepparent or relative is an applicant, the Courts use a Specific issue Order to change the child’s surname.
