Child Support

The payment made by one of the parents, usually the parent without custody to the parent with custody for the upbringing of their common child. The best thing that can happen to a child is when both its parents pay for its upbringing. The child support order from a Court clearly mentions when, how often and how much a parent has to pay for child support. A portion of the divorce decree essentially contains a child support order. If neither of the parents are in custody of the child after a divorce, then the Court might also order the parents of the child to pay child support to a third party, who looks after the child and cares for him. Every child has the right to child support for his proper upbringing irrespective of the fact who looks after him. If the custodial parent has a higher income, that does not deprive the child from getting child support because the child is liable to get child support from the income of both its parents. Child support can be increased or decreased from time to time according to the requirements of the child. The welfare and proper upbringing of the child is of prime consideration.

When an unmarried mother claims child support, the first thing that she has to do is to establish the paternity of the child. Although the father can accept the child voluntarily, if he refuses to do so, then the mother can establish the paternity of the child through a Court wherein the court will order for the DNA test, which would proof beyond doubt the paternity of the child. Once the paternity is established, the Court will order the father to pay the child support just in the manner it would have done in case of a divorce.
