Section 33 of the Environmental Protection Act of 1990 provides for compulsory licensing for operators of waste disposal facilities in order to induce greater professionalism and technical competence. Only fit and professional persons with requisite technical competence are allowed to run and operate waste management facilities.
Since the introduction of the Environmental Protection Act of 1990 even when the waste disposal operations have come to an end with the operating licence technically no longer in force, the concerned operator continues to be responsible for ensuring that the land in question is unlikely to cause pollution of the environment. The concerned authority will accept surrender of licence by such operator only upon satisfaction that the said parcel of land no longer poses environmental risk. Otherwise the said operator would not stand released or discharged from his obligations.
