Dispute resolution process is broadly of two types
- Judicial
- Non judicial or consensual or alternative dispute resolution
Dispute resolution through public justice delivery system in courts is the judicial determination of disputes.
Alternative dispute resolution i.e. ADR is alternate to litigation in court. It covers;-
- Arbitration
- Conciliation
- Mediation
- Expert determination
- Negotiation
Arbitration is a process of resolution of disputes outside court by a private judge of the parties by whose decision or ‘award’ they have agreed to be bound by.
Conciliation is a process in which an agreed neutral person i.e. the conciliator tries to induce the parties to come to an agreed settlement themselves without deciding anything himself. However, the conciliator can offer advice or suggestions to the parties. In many jurisdictions, such as India, settlement
