Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 is the law against Spam.
Since 1st January 2004 the said anti Spam law has come into force in the USA.
Marketers using this channel of communication are obliged to discharge certain statutory duties.
They must provide the customers with automatic opt out routes for 30 days after mailing and furnish their own particulars including physical address and phone. At the request of the customer the marketer must remove his name from the mailing list within 10 days of receipt of such request.
The law also forbids the practice of using misleading headers. The header must contain the originating domain name and the sender’s e-mail address. Subject lines must be a truthful and fair representation of the text of the message and must indicate that the communication is an advertisement.
Email harvesting or collection of email addresses by use of software that spider the websites is prohibited.
There must be statutory warning for emails with sexually oriented inputs.
