In general terms, stalking refers to ‘harassing or threatening behaviour that an individual engages in repeatedly towards another person’. In the real world, there are glaring instances of stalking of celebrities. After the advent of the internet, even common people are becoming victims of Cyber Stalking. Internet has become an integral part of our personal and professional lives. Though Cyber Stalking does not involve physical contact, it has the potential to cause serious damage to the person and property of an individual. There is the legal remedy of injunction for the victims of stalking under the Code of Civil Procedure, 1908. Since, there is no specific law on Cyber Stalking in India the law enforcement Department is not well equipped to deal with the crime. However, the victims of Cyber Stalking in India can take recourse to provisions of Indian Penal Code for the already existing offences of assault, nuisance, etc. So, it is wise to adopt preventive measures against Cyber Stalking.
