Laws relating to Telemarketing Fraud have been dealt under the US Code in Part 1 of Title 18
According to the US Code, telemarketing means: "plan, program, promotion, or campaign that is conducted to induce:
- purchases of goods or services;
- participation in a contest or sweepstakes; or
- a charitable contribution, donation, or gift of money or any other thing of value, by use of 1 or more interstate telephone calls initiated either by a person who is conducting the plan, program, promotion, or campaign or by a prospective purchaser or contest or sweepstakes participant or charitable contributor, or donor."
Any person, convicted for a telemarketing fraud, shall be punished by imprisonment for a maximum term of 5 years. For aggravated forms of telemarketing frauds, the punishment may extend up to 10 years of imprisonment.
