All defendants have a Sixth Amendment Right to proceed on their own behalf without the representation of counsel. In fact he has the right to represent himself. In order to avail of this right of self representation, he must make an informed waiver before the court of his Sixth Amendment Right to Counsel. He must be aware that criminal defense calls for legal skill and acumen.
In the case of Godinez v, Moran, 509 U.S. 389 (1993) the Supreme Court held that even if the state believed that the accused is not competent to proceed without counsel in his defense, it cannot interfere with his decision to waive counsel.
