The unlawful killing of a human being without malice is termed as manslaughter. This provides the basic difference between the offences of manslaughter and murder where, presence of malice is a fundamental ingredient.
Manslaughter which happens upon a sudden quarrel or provocation or heat of passion is termed as voluntary manslaughter.
Involuntary manslaughter includes an unlawful act which does not amount to felony or done without any due diligence.
A person guilty of voluntary manslaughter is imprisoned for a maximum term of ten years, or fine, or both.
A person guilty of involuntary manslaughter is imprisoned for a maximum term of six years or fine or both.
An attempt to commit manslaughter is punished by imprisonment for a term not more than seven years or fine, or both.
