The offence of kidnapping occurs when a person is taken away to an unnamed location against his will with a general intention to extract money in the form of ransom.
The term kidnapping, not in a very strict sense, can be associated with abduction.
Any person convicted on charges of kidnapping, shall be punished by imprisonment for any term of years which may even extend for life. If the act of kidnapping results in the death of any person, the wrongdoer shall be punished by death or life imprisonment.
However, if the person kidnapped is below the age of eighteen years and the wrongdoer has attained such age and is not a parent; a grandparent; a brother; a sister; an aunt; an uncle, or an individual having legal custody of the victim, then, the sentence shall be an imprisonment for not less than 20 years.
It must be mentioned here that the term “parent” excludes a person whose parental rights with reference to the victim have been terminated by a final order of the court.
