The provisions relating to firearm are incorporated in Title 18, Chapter 44 of the US Code.
According to the US Code, the term fire arm means:
- "Any weapon, including a starter gun, which will or is designed to or may readily, be converted to expel a projectile by the action of an explosive;
- the frame or receiver of any such weapon;
- any firearm muffler or firearm silencer, or
- any destructive device ( Such term does not include an antique firearm )"
Similarly, the term "destructive device" means:
- any explosive, incendiary, or poison gas,
- bomb,
- grenade,
- rocket having a propellant charge of more than four ounces,
- missile having an explosive or incendiary charge of more than one-quarter ounce,

According to the US Code, it is illegal for any person (except a licensed importer, licensed manufacturer, or dealer holding a valid license), to involve into the activity or business of importing, manufacturing, or dealing in firearms, or to ship, or transport, any firearm without holding a valid license or proper permit to do the same.
