Aggravated sexual abuse takes place when any person by application of physical force, fear of death or injury or kidnapping, is made to submit to sexual acts.
Any person in a Federal prison, or in any prison, who intentionally causes another person to submit to a sexual act by application of force against that person; or by threatening or placing that other person in apprehension that any person will be subjected to death, serious bodily injury, or kidnapping, shall face a fine or an imprisonment for any term of years or life, or both.
Any person who commits a sexual act with another person who has not attained the age of twelve years, or with another person who has attained the age of twelve years but has not attained the age of sixteen years and is at least four years younger than the person, shall face a fine and imprisonment for not less than thirty years or for life. In such an action, the prosecution need not prove that the defendant had the knowledge that the other person involving in the sexual abuse had not attained the age of twelve years.
