Hurt

Section 319 of the Indian Penal Code states “Whoever causes bodily pain, disease or infirmity to any person is said to cause hurt.”

Hurt can further be classified into two categories –

simple hurt
grievous hurt

To constitute the offence of hurt the following conditions must essentially be fulfilled-

it must cause bodily pain
disease, or
infirmity to another person

In order to constitute an offence of grievous hurt, the following conditions are required to be fulfilled –

There must be some form of Emasculation, or,
Permanent privation of the sight of either eye, or,
Privation of any member or joint
Destruction or permanent impairing of the powers of any member or joint
Permanent disfigurement of the head or face
Fracture or dislocation of a bone or tooth
Any such hurt which can endanger life
Any such hurt which causes the sufferer to be for a time span of twenty days in severe body pain, or unable to follow his ordinary pursuits.
