In those cases where due to the nature of the contract compensation in money would never be adequate relief for breach or violation of the same, the court may direct specific performance of the contract at its discretion. For instance, when the seller refuses to give delivery of a unique or rare antique already sold to the buyer, it is a fit case for the court to utilize its discretion to direct specific performance of the contract.
In case of sale of real estate or immovable property, courts are generally inclined to grant the discretionary relief of specific performance.
In employment contracts or contracts for personal services, the remedy of specific performance is not available in law.
The relief of specific performance is always at the discretion of the court and the aggrieved party cannot claim it as a matter of right.
