The General Safety essentials set forth under section 10 of the Consumer
Protection Act 1987 has been outdated by the General Product Safety Regulations 1994 (the GPS Regulations), with effect from 3 October 1994. The GPS Regulations under the European Communities Act 1972 has put into practice the General Product Safety Directive which has initiated an extensive wide-ranging safety duty.
The system of “approved standards” under section 10 of the Act has eventually got annulled by the General Product Safety Regulations 1994. The commendations which had been made under that provision were cancelled by Administrative Act from 2 August 1994. The principles which until that time had approved status continue to remain in being as principles of safety. Section 11 of the Act facilitates the Secretary of State to make urgent situation policy, without consultation, when it is necessary on grounds of public protection. However any regulation made under this course of action lapses after a span of 12 months.
