Most of the arbitration agreements contain provisions for the appointment of arbitrator or arbitrators, as the case may be.
Arbitration agreement itself may either designate anybody by name or the holder of any particular post as arbitrator or provide the mechanism for arbitrator appointment.
There may be arbitration of a sole arbitrator or a panel of arbitrators.
In arbitration of three arbitrators both the parties appoint one arbitrator each and those two arbitrators chosen by the parties nominate the neutral third arbitrator. Alternatively, when the agreement so stipulates the neutral third arbitrator must be a mutually agreed person of both the sides.
