Rights are derived from remedies. There are many instances of rules of law which have been drawn out from the system of remedies, such as the remedy of habeas corpus. Habeas corpus was the foundation of personal liberty which grew out of a writ in the medieval age and was used to secure the appearance of a party where he was in particular under detention by some inferior court. Finally, the remedy of habeas corpus became the standard procedure by which the legality of any imprisonment could be tested. The procedural rules brought out the ‘right to personal freedom’ as a consequence. For a considerable period of time, the remedies employed in administrative law belonged to two different classes and there were several anomalies caused by this fact. The class of ordinary private law remedies we comprised damages, injunction and declaration; and the special class of public law remedies, principally were certiorari, prohibition and mandamus, collectively known as the prerogative remedies. The statutory remedy for special situations is the third category of remedies. Under the ordinary and prerogative class various remedies could be sought against public authorities either separately or together or alternatively. However, each class possessed its own distinct procedure.
